If you violate this Agreement, 8 Days a Week may, in its sole discretion, delete the unacceptable content from your Posting, remove or delete the Posting in its entirety, issue you a warning, and/or terminate your use of the 8daysaweek.co website or provide your personal information to third parties to enable them to take legal action in respect of unlawful or infringing content published by you on 8daysaweek.co website.

Applicable Law and Disputes
This Agreement, your rights and obligations, 8 Days a Week’s rights and obligations, and all actions contemplated by this Agreement will be governed by California law, without regard to principles of conflicts of law and as if this Agreement were a contract wholly entered into and wholly performed within the Netherlands. This Agreement will not be governed by the United Nations Convention on Contracts for the International Sale of Goods. Further, you also acknowledge and agree that any applicable state law implementation of the Uniform Computer Information Transactions Act (including any available remedies or laws) shall not apply to this Agreement and is hereby disclaimed.
Any dispute relating in any way to your visit to the 8daysaweek.co website shall be submitted to the competent California Court.
You acknowledge that any breach, threatened or actual, of this Agreement, including, without limitation, with respect to unauthorized use of 8 Days a Week proprietary assets, will cause irreparable injury to 8 Days a Week, such injury would not be quantifiable in monetary damages, and 8 Days a Week would not have an adequate remedy at law. You therefore agree that 8 Days a Week shall be entitled, in addition to other available remedies, to seek and be awarded an injunction or other appropriate equitable relief from a court of competent jurisdiction restraining any breach, threatened or actual, of your obligations under any provision of this Agreement. Accordingly, you hereby waive any requirement that 8 Days a Week post any bond or other security in the event any injunctive or equitable relief is sought by or awarded to 8 Days a Week to enforce any provision of this Agreement.
You agree to defend, indemnify, and hold harmless 8 Days a Week and its affiliates, successors and assigns, and its directors, officers, employees, agents, co-branders or other partners from and against any and all allegations, claims, demands, actions, causes of action, proceedings (whether threatened or pending), orders, damages, losses, liabilities, costs and expenses, including reasonable attorneys’ fees and other legal expenses, and judgments of any kind or nature, incurred by 8 Days a Week arising out of or relating to your use of the 8daysaweek.co website and your violation of this Agreement or relating to any payment dispute with a third-party provider arising from a purchase or incurrence of fees made by you.
Term and Termination
This Agreement will take effect at the moment you click “Accept”, register, respond to a request for information, and/or begin downloading, accessing, or using the 8daysaweek.co website, whichever is earliest. 8 Days a Week reserves the right at any time and on reasonable grounds, which shall include, without limitation, any reasonable belief of fraudulent or unlawful activity or actions or omissions that violate any term or condition of this Agreement, to deny your access to the 8daysaweek.co website or to any portion thereof in order to protect its name and goodwill, its business, and/or other users, and this Agreement will also terminate automatically if you fail to comply with its terms and conditions, subject to the survival rights of certain provisions identified below. Termination will be effective without notice. You may also terminate this Agreement at any time by ceasing to use the 8daysaweek.co website, but all applicable provisions of this Agreement will survive termination, as identified below, and each re-access or use of the 8daysaweek.co website will reapply this Agreement (then in effect) to you. Upon termination, you must destroy all copies of any aspect of the 8daysaweek.co website in your possession. The provisions concerning 8 Days a Week's proprietary rights, feedback and submissions, indemnity, disclaimers of warranty and liability, waiver and severability, miscellaneous legal terms, and governing law will survive the termination of this Agreement for any reason.

We may change the contents, operation, or any and all other features of the 8daysaweek.co website at any time for any reason, without notice. We may discontinue or restrict your use of the 8daysaweek.co website at any time for any reason, without notice.
You agree that no joint venture, partnership, employment, or agency relationship exists between you and 8 Days a Week as a result of this Agreement or your use of the 8daysaweek.co website. Nothing contained in this Agreement is in derogation of 8 Days a Week’s right to comply with governmental, court, and law enforcement requests or requirements relating to your use of the 8daysaweek.co website or information provided to or gathered by 8 Days a Week with respect to such use. A printed version of this Agreement and of any notice given in electronic form shall be admissible in judicial or administrative proceedings based upon or relating to this Agreement to the same extent and subject to the same conditions as other business documents and records originally generated and maintained in printed form.
The failure of 8 Days a Week to enforce any provisions of this Agreement or respond to a breach by you or other parties shall not in any way waive its right to enforce subsequently any terms or conditions of this Agreement or to act with respect to similar breaches.
If any provision in this Agreement is invalid or unenforceable under applicable law, the remaining provisions will continue in full force and effect, and the invalid unenforceable provision will be deemed superseded by a valid, enforceable provision that most closely matches the intent of the original provision.
This Agreement is the entire and final Agreement regarding the 8daysaweek.co website and their content, and supersedes any prior or contemporaneous communications between 8 Days a Week and you regarding the 8daysaweek.co website and their contents.
All rights not expressly granted herein are hereby reserved.
